Defect. CUMMINS WESTPORT B GAS PLUS OR C GAS PLUS 6 CYLINDER ENGINES BUILT FROM JUNE 2001 THROUGH MARCH 2003. THE ELECTRONIC CONTROL MODULE CALIBRATION MAY NOT CORRECTLY DETECT A THROTTLE PLATE ACTUATOR FAILURE THAT COULD RESULT IN AN UNCOMMANDED OPEN THROTTLE CONDITION.

Risk. IF THIS EVENT OCCURS, THE VEHICLE OPERATOR WILL NOT HAVE CONTROL OF THE ENGINE SPEED WHICH COULD POSSIBLY RESULT IN A VEHICLE CRASH.

Remedy. CUMMINS WILL NOTIFY ITS CUSTOMERS AND REPLACE THE ELECTRONIC CONTROL MODULE CALIBRATION FREE OF CHARGE. OWNER NOTIFICATION BEGAN APRIL 7, 2003. OWNERS WHO TAKE THEIR VEHICLES TO AN AUTHORIZED DEALER ON AN AGREED UPON SERVICE DATE AND DO NOT RECEIVE THE FREE REMEDY WITHIN A REASONABLE TIME SHOULD CONTACT CUMMINS CUSTOMER ASSISTANCE CENTER AT 1-800-343-7357.

The vehicle experienced catastrophic engine failure due to burning oil. At no point did warning lights or alerts appear on the dash. This failure occurred well within the terms of Kia’s 10-year/100,000-mile powertrain warranty. I was informed by the dealer that warranty coverage is being denied because I do not have every oil change or service record available. I want to emphasize that under the Magnuson-Moss Warranty Act, Kia cannot deny warranty coverage solely due to lack of receipts unless Kia can prove that the absence of maintenance directly caused the failure. Premature engine failure due to excessive oil consumption is a known defect and not the result of neglect. Kia is refusing to replace the engine, the vehicle has been at the dealership for 3 weeks now with no resolution.
